These terms govern the services provided by ZK Digitals to you. By engaging us or using this website, you accept them. Where a signed proposal or scope of work exists, that document takes precedence on any point it covers.
The services we will deliver, the timeline and the fee are set out in the proposal or scope agreed before work begins. Anything not stated in that document is outside scope and will be quoted separately.
One-time work is invoiced with a deposit before commencement and the balance on delivery. Monthly retainers are invoiced in advance. Prices exclude VAT where applicable. Advertising spend is paid by you directly to the platform and is never included in our fee.
Monthly services run month to month with no minimum term. Either party may end the engagement with 30 days' written notice. Work already performed and invoiced is payable.
On full payment, all deliverables produced for you — website files, content, campaign assets and reports — belong to you. Accounts remain in your name throughout. We retain the right to reference the work in our portfolio unless you ask us in writing not to.
Digital marketing outcomes depend on factors outside our control, including search engine and advertising platform algorithms, competitor activity, market conditions, seasonality, your pricing and your product. We do not guarantee specific rankings, traffic volumes, conversion rates, revenue or return on advertising spend. Any projection we provide is an estimate based on available data, not a promise.
Our work depends on platforms operated by Google, Meta, TikTok and others. We are not responsible for account suspensions, policy changes, algorithm updates, outages or pricing changes made by those platforms. Where a suspension results from our error we will work to resolve it at no charge.
To the maximum extent permitted by law, our total liability arising from or connected to an engagement is limited to the fees you paid us in the three months preceding the claim. We are not liable for indirect or consequential loss, including lost profits, lost revenue or lost data.
Each party will keep the other's non-public business information confidential and use it only for the purpose of the engagement.
We may update these terms. Changes take effect from the date published here and apply to engagements entered into after that date.
These terms are governed by the laws of the United Arab Emirates, and the courts of the United Arab Emirates have jurisdiction over any dispute.
